Dear Colleague,

In every personal and business relationship, there can occur misunderstandings and misinterpretations which are best dealt with "within the family". The tourist industry industry is no exception. In its endeavours to expand and develop new business, our industry sometimes creates specific problems which cannot be easily defined by the small print of the law.
The Israel Tourism Association is well aware of such problems, and in order to protect its members and their associates have established the Ethics Committee. The Committee, which acts as an independent body within the Tourist Association, has created a Code of Ethics for its members in Israel. This Code has been approved by the General Assembly of the Tourist Association and is binding on all its members.
Any individual or organisation can use the services of the Ethics Committee. In all disputes concerning ethics where either individuals or organisations are involved, we strongly recommend seeking the counsel of the Ethics Committee.
We trust that this new instrument will assist all of us in finding answers to the problems in our industry, to the benefit of all concerned.

Definitions

1.

In these Rules:
the Association - means the Israel Tour Operators Assocation.
Association members - includes their branches and/or those who are candidates to be Association members and/or their branches.

 

General

2.

The Association members shall carry on their business loyally and diligently, whilst maintaining fairness and the honour of the profession and its status.
 

3.

The Association members shall take pains to maintain the good name of the profession and those engaged in it.
 

4.

The Association members shall comply with all the provisions of the Association's articles and the orders of its organs; they shall act in accordance with directives and take pains to comply with all provisions of law, whether government or other, relating to and/or connected with the travel industry in Israel and the rest of the world.
 

5.

The Association members shall comply with all provisions of agreement to which they are a party, including local and international agreements.

 

Relations Towards the Public

6.

The Association members shall supply their customers with efficient service to the best of their professional knowledge and experience as obliged by their engagement in the tourism industry and at fair prices acceptable in the tourism industry.
 

7.

For services for which a price is not fixed, the Association members shall charge a reasonable price acceptable in the tourism industry.
 

8.

The Association members shall take pains to advertise fairly and without misleading. Any advertisement or agreement which contains false and/or misleading particulars and/or which is based on incorrect facts and/or plans which are incapable of performance is strictly forbidden.
 

9.

The Association members shall take pains to conduct fair negotiations which are not misleading.

 

Relations with the Suppliers of Services

10.

The Association members shall take pains to maintain fair relations with the suppliers of services.
 

11.

The Association members shall honour their obligations towards the suppliers of services and act in accordance with the general arrangements and agreements duly laid down by the Association and any other agreement between the parties insofar as such exists.
 

12.

The Association members shall refrain from giving and/or promising to give an improper benefit to a supplier of services and/or any of his employees in order to obtain any discount and/or concession and/or other benefit and/or any agreement and/or arrangement with the supplier.

 

Relations between Members

13.

In every professional matter the Association members shall act fraternally towards their colleagues and refrain from unfair competition.
 

14.

The Association members shall refrain, both in writing and and orally, without reasonable justification from any publication which might damage their colleagues and/or harmfully represent them either personally or commercially.
 

15.

An Association member who knows that an individual is the employee of and/or acts for another member, shall refrain from approaching him with an offer of work without obtaining the consent of his employer.
 

16.

An Association member may not make use of his employees' information and/or commercial connections which are the result of and/or derive from his being employed by his previous employer for a period of two years from the end of his employement with that member.
 

17.

An Association member shall not employ or have any commercial connections either himself and/or through others, either directly and/or indirectly, with another Association member who has been declared bankrupt and/or against whom a winding up order has been made and/or who has been convicted of an offence involving ignominy, unless it has been established to him that the member has reached an arrangment in respect of his debts and liabilities and before employing him has referred the matter for the ruling of the ethics committee or such person as it has empowered in such respect.
 

18.

Should an Association member after beginning to deal with the matter of a particular customer and/or supplier learn that the customer and/or supplier has a financial dispute with another Association member, he shall not continue dealing with the matter of the particular customer and/or supplier until after either:

A)

the Association member who has a dispute with the customer and/or supplier gives a written notice that he does not object to the other member handling the matter of the particular customer and/or supplier; or
 

B)

the member refers the matter for a ruling of the ethics committee of the Association or such person as empowered in such respect and obtained its approval to continue dealing therewith.
